What We Do

KnowClick is focused on collecting and analyzing user feedback data to help improve the user experience at websites. We collect data on our own Website (www.knowclick.com) and on the websites of our Clients who use our Services. We typically collect data through website surveys and tracking website activity.

Our Commitment

KnowClick considers the privacy of the people using our Website and those using our Services on Clients’ websites to be of critical importance. We will never sell your Personal Data to anyone, ever. Additionally, we take many precautions to protect your Personal Data.

About This Policy

This Privacy Policy applies to and describes how KnowClick LLC (“KnowClick,” “we,” “us,” or “our”) collects, uses, and discloses the information you provide to us when either using our Website or our Services at our Clients’ websites (such as taking a survey at one of our Client’s websites or via an email invitation.)

Definitions

“KnowClick,” “we,” “us,” or “our” refers to KnowClick LLC.

“Website” refers to KnowClick.com and other websites run by KnowClick.

“Services” refers to our services typically on our Clients’ websites or applications, primarily surveys but this can also include website behavioral tracking and similar.

“Personal Data” refers to any information that identifies or can be used to identify an individual, such as name, address, email, phone, and similar.

“Client” refers to the company contracting KnowClick’s Services, whereby we run surveys and tracking at their website. This includes many Fortune 500 and many smaller companies.

“You,” “your,” “respondent,” or similar refers to the website visitor.

Please read this entire Privacy Policy to understand our policies and practices on capturing and using information about you and your website visit. If you do not agree with our policies and practices, do not use our Website and do not participate in our Services on our Clients’ websites. By accessing or using our Website or participating in any of our Services at our Clients’ websites, you agree to this Privacy Policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Website or our Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Data Collection & Purpose

KnowClick collects data on our website, through using our Services on our Clients’ websites, and through our Services for Clients using email or text messaging. Our data is primarily collected from running surveys and tracking website activity.

Our surveys ask a variety of questions which can capture many different types of data. You are typically not required to answer a survey to view our Website or view our Clients’ websites. Additionally, most questions are optional. Most of our surveys are anonymous. To opt out, simply do not take our surveys.

Some surveys run for our Clients include an option for providing Personal Data, such as an email address, name, and/or phone number. This Personal Data is typically used to send a future survey to that user or deliver an incentive and is optional. This Personal Data is never sold and is not provided to anyone who is not working on behalf of either KnowClick or our Client (unless noted otherwise in “Disclosures of Personal Data” below) . Occasionally the user is asked if they want to be contacted by our Client or added to the Clients’ email list. If the user consents to be contacted or added to this list, their contact information would be provided to the Client for that purpose. If you are a website visitor of one of our Clients or have an existing relationship with one of our Clients, you should refer to that Client’s posted privacy policy regarding how Personal Data is collected and used by companies working on behalf of that Client.

Unsolicited Personal Data: we may inadvertently collect Personal Data or sensitive information (such as health or ethnic information) when you voluntarily provide such information in “open-text” type questions. If you voluntarily provide us with Personal Data or sensitive information, you consent to the use of such information in accordance with this Privacy Policy.

We track website activity, such as clicks, downloads, mouse movement, referring sources, and other commonly tracked behaviors. We also often track web browser type, screen resolution, operating system, and may include the IP address, unique device identifier (“UDID”), international mobile equipment identity (“IMEI”), mobile equipment identifier (“MEID”) or media access control “MAC”) address and other commonly captured identifiers and measures. Additionally, we may collect other data on our Clients’ websites. See the Client’s privacy policies to see what data may be collected.

In some instances, a Client may provide KnowClick with data about its customers or website visitors, which may include information about their use of the Client’s website, transactional history with the Client, or other data. KnowClick and/or the Client may combine this information with the data we collect in order to better understand your feedback. See the Client’s posted privacy policy to identify what information the Client may have available to provide to third-parties working on behalf of the Client, such as KnowClick. We may also receive information about you and your activities on and off the Services from third-party partners, such as a market research partner who provides us with information about you or your engagement with our Services, and whereby we may combine this with other information we have collected on you.

The data KnowClick collects either belongs to our Client or to KnowClick depending on the contractual relationship between KnowClick and the Client and where & how the data was collected. KnowClick uses the data to compile reports and provide improvement recommendations for our Clients. Aggregated anonymous data may also be used for case studies, presentations, and other marketing materials and does not include any Personal Data.

When we collect and access Personal Data on our Clients’ websites to their visitors and customers, we are acting as a data processor on behalf of our Clients under their strict instructions. We process this Personal Data in accordance with their requirements and our contractual agreements with these Clients. In these cases, our Clients are the data controllers and data owners.  If you are a website visitor or a customer of one of our Clients, you should refer to that Client’s website to understand how their privacy practices apply to your Personal Data.

KnowClick may email surveys to website visitors and customers of our Clients, typically to those who opted into a survey or opted in to the Client’s email list. Given that KnowClick is acting as the Client’s agent, if the customer or website visitor chooses to opt-out of future emails when they receive a survey invitation, the opt-out will be Client-specific and limited to opting out of receiving email surveys related to this Client.

If you visit our Website located at www.KnowClick.com and choose to contact us or access certain materials, you may be asked to provide certain Personal Data about yourself, such as your name, email address, or phone number. We use this information to communicate with you and provide the information requested.

If you are one of our Clients, you may be able to create an account on our Website to access to the Services you have contracted. During registration, you will be asked to provide Personal Data about yourself (such as your name and email address). This information, as well with any other Personal Data collected during our contractual relationship, will be used to provide you with our Services and technology solutions in accordance with the agreement executed between your company and us. This includes giving you access to our Services, providing customers’ support, communicating with you about your use of the Services. We can also use this information to help us to improve our products and services.

If you are a survey respondent located in the European Economic Area (“EEA”), each of our Clients processing your Personal Data is required under the General Data Protection Regulation (“GDPR”) to provide you with information or access to their privacy policy explaining how they will process your data. Please check their privacy policies before you submit any Personal Data on our platform. If you do not agree with the content of their privacy policies, do not reply to the survey and do not share information with us. If you wish to see, control, or delete the data that our Services have collected related to you and your website activity, see “Accessing and Controlling Your Personal Data” below.

We typically do not request, access or otherwise track any location-based information from your mobile device.

KnowClick does not sell any Personal Data collected from survey respondents & website activity and does not share any Personal Data with third parties who are not working on behalf of KnowClick or the respective Client.

In some cases, Personal Data may be disclosed to our Client (on whose website or property we collected the data) in accordance with the KnowClick-Client contractual relationship and as set forth in this Privacy Policy and the Client’s privacy policy. This disclosure typically occurs if the user indicates that they want to be contacted by our Client, added to the Clients’ email list, or if the Client wants to respond to specific feedback.

We may provide your data, including your Personal Data, to entities (such as vendors, consultants, agents, etc.) that provide services to help us with our business activities (“Partners”) and to entities that are working on behalf of our Client (on whose website or property we collected the data). These services may include, for example website analytics, market research tools, hosting services or email services.

We may also disclose your data:
 

  • To provide you with any information or services that you request;

  • To respond to subpoenas, court orders, and other legal process, or as otherwise required by law;

  • To exercise our legal rights or defend against legal claims, to enforce our contracts, to investigate, respond to and resolve problems or inquiries (including governmental inquiries), or to permit us to pursue available remedies or limit the damages that we may sustain;

  • With our affiliates, subsidiaries, or parent companies; and

KnowClick retains all data, including the Personal Data we process on behalf of our Client, for as long as needed to provide Services or as necessary to comply with our legal and regulatory obligations, to demonstrate compliance, to resolve dispute and to enforce our rights and agreements or for a period of 3 years, whichever is longer. In some cases where Personal Data is needed only to send an immediate survey via email or text, that Personal Data may be deleted after sending.

KnowClick takes reasonable precautions to protect Personal Data on its system from misuse and unauthorized access, disclosure, alteration, and destruction. We use secure server hosting locations with 24×7 security monitoring, firewall protection, controlled access, and encryption technology to protect your Personal Data. No method of transmission over the Internet and no method of electronic storage is 100% secure, we cannot guarantee nor warrant its absolute security. KnowClick has a business continuity plan for the event of a data center failure or disaster. However, there is no guarantee that we can fully recover all data in the event of such a disaster or failure.

If you are located outside of the United States, please be aware that your Personal Data may be transmitted, stored, and processed in the United States.  By using our website, contracting with us to receive our products or services, or submitting any information to us through our Services, you consent to this transfer, processing and storage of your information in the United States, a jurisdiction that may or may not provide the same level of privacy protection as the laws in your home jurisdiction.

Cookies are uniquely assigned to you. We primarily use first party cookies when providing our Services on our Clients’ websites. These cookies exist to prevent our surveys from displaying more than once in a time period and to assist in tracking behavior and triggering surveys.

KnowClick typically uses cookies and similar technologies on our Websites and when providing Services to measure website performance, administer the website, and track the content used at the website in order to know what is important to our users and what is not. We may use a third-party tracking service that uses images, scripts, page tags and other tracking technologies to track information about visitors to our Website.

We allow third parties working on our behalf to use first and third party cookies and web beacons on our own Website (www.knowclick.com), typically for marketing purposes.

Users can control the use of cookies at the individual browser level. You have the ability to accept or decline cookies. Most web browsers accept cookies by default, but you can often modify your browser setting to decline cookies by changing the browser preferences. If you choose to decline cookies, the website experience at ours and other websites may be more limited.

Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, we currently do not take action in response to these signals. If and when a final standard is established and accepted, we will reassess how to respond to these signals. If our Client acts on these, they typically would prevent our Services from operating for that visitor.

Our Website and our Services are typically intended for people 18 years of age and older.

In some cases, our Clients who use our Services may offer content developed for children and/or children’s products for purchase by adults. If you are under 18, you should only participate in our surveys with the permission of a parent or guardian.

We typically do not collect Personal Data on Children 13 to 17. In the occasional case where our Clients want us to collect such Personal Data and it is permitted by law and their privacy policy, these Children should only provide us with Personal Data if they have explicit permission from a parent or legal guardian.

Children under 13 may not submit any Personal Data to us, and if we discover that we have unintentionally collected any Personal Data on a child under 13, we will take appropriate steps to promptly delete it.

Accessing & Controlling Your Personal Data

If you wish to see, control, or delete the data that we or our Services have collected on you, you will need to do the following:

If this request is related to a visit to our Website (www.knowclick.com), contact us as noted in “Questions and Contacting KnowClick”.  We are the data controller of your information. When contacting us, include your name, email address, and any additional information we would need to reply to your request and we will reply to your request within 30 days.  In order to safeguard the Personal Data we have collected, please note that we will have to take steps to confirm your identity before providing access to or deleting your data.

If you visited one of our Client’s websites where our Services such as surveys are run, your data is owned by our Clients as they are the Data Controller of your Personal Data, so they are responsible for handling and replying to your request. They will inform us if we are needed to comply with your request. If you decide to contact us anyway, note that we will send your request to our Client in order for them to reply to your request. In this case, we will need you to provide us with the following information in order to identify you and our Client: the website on which you took the survey or visited, your name or the email that you would have inputted, your IP address and any other information that will help them to identify you and find your Personal Data. Please communicate directly with the Client if you want to access, update, or delete any data collected, some of which may have been collected by KnowClick and some by the Client or third-parties working on behalf of the Client. Any change or deletion to your data will be limited to data related to the given Client and not to any data that KnowClick collected on other Clients.

If you are an EEA resident, you have specific rights regarding the handling of your information under the EU General Data Protection Regulation. The data controller of your personal information must reply to your request relating to: your right to be informed; your right of access; your right to rectification; your right to erasure; your right to restrict processing; your right to data portability; your right to object and your rights in relation to automated decision making and profiling. Some of your rights may be subject to some limitations or exceptions.

If you are a California Resident, we do not share information that we collect with third parties for the third party’s direct marketing purposes. Under California Civil Code §1798.83, California residents have the right to receive, once a year, information about third parties with whom we have shared information about you for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared. To make such a request, please contact us at the address below. We will respond to you within 30 days of receiving such a request.

You have the right to access your Personal Data.  If you would like to access and review Personal Data that you provided to us, you can either contact our Client with any such requests, or make your request directly to us as noted below.  We will cooperate as appropriate with requests from our Clients to assist with such responses and will respond to such requests within 30 days or less.
